Notes from the 3/12 community meeting.
Opened meeting with pledge of allegiance.
Foreclosure - currently (3/1/13) still in the hands of the court for final decision. Both parties, Paparone and Wells Fargo, continue to supply the court with information and financial data to support their positions so that the court can then determine the final outcome. So we have no prospect of
sales and building of the open lots in the near term and no time-line is
available for when that may happen.
Receiver - on 12/11/12 the court appointed Rouse/Chamberlin (R/C) as receiver for Country Gardens. R/C role is to manage, operate and preserve all of the real and personal property of Country Gardens, essentially all of the unimproved parcels. R/C will not be marketing, selling, or building the
unimproved lots, only to secure and maintain them.
The judge ruled that R/C is to take over the three HOA Board member positions currently held by Paparone Housing, but that Paparone Housing is entitled to attend/participate in all HOA meetings and give guidance to the HOA Board as requires/needed. R/C appointments to the Board are Stephen Gallo, Jonathan Penders and Greg Graham. Bob Frye will remain as a liaison to Paparone Housing.
Greg Graham (R/C) attended our 3/12 community meeting and shared
who R/C is, where they currently have other receiver-ships, and what their roles and responsibilities are at Country Gardens. When appointed, R/C obtained a street snow removal contract immediately. R/C is currently seeking bids for the maintenance of the open lots (grass cutting and trimming) as we move into spring. In addition, safety fencing has been installed around the four open foundations.
We are trying to get clarity from the court as to who is responsible for
cleanup of the construction trailer area and when it might be cleaned-up.
We also would like to see some cleanup of mounds of dirt and piles
of cinder block on some of the open lots. Our objective is to get the site
cleaned-up and made much more presentable as we approach the coming
spring and summer.
Note that the HOA is not responsible for and does not pay for any of the workbeing done by R/C.
Mantua Township - has requested a new street paving inspection to identifyrecommendations for immediate repairs and forward the report to R/Cfor action to prevent further deterioration of the base paving.
Clubhouse enhancements- in March of 2012 , a vote was taken to use
some of the money in the Capital Reserve for enhancements to the
clubhouse. The vote was passed but contingent on the HOA getting
the deed to the clubhouse. Now that the HOA owns the clubhouse and the
surrounding recreational area, to-date the following have been completed:
The newly formed Decorating Committee will be meeting with the
Board to present their thoughts for further enhancements to the clubhouse. These expenditures will be from the capital reserve, not the everyday HOA operating budget.
Meeting Dates for 2013 - Community meetings for 2013 will be held on the second Tuesday of March (12th), June (11th), September (10th) and November (12th -annual Board meeting) at 7:00 pm in the clubhouse.
